Payoff Procedures


A debtor who wishes to pay off his or her plan earlier than a confirmed plan provides for must contact the office of the Chapter 13 Trustee, to discuss their proposed method of doing so. In the case of a proposed refinance, before a payoff amount can be calculated, to ensure compliance with § 1325(a)(4) the debtor will need to provide this office with a copy of the current appraisal that the prospective new lender is relying upon. A borrower's authorization will need to be provided to this office to allow dissemination of pay histories at a debtor's request to a prospective lender. All responses by this office will be made thorough the debtor's bankruptcy attorney's office. Please allow at least two weeks to process such requests.
